On November 4, 2021, the federal Occupational Safety and Health Administration ("OSHA") published the long awaited Emergency Temporary Standards ("ETS") regarding mandatory vaccination and COVID-19 testing obligations. The ETS provisions went into effect on November 5, 2021. However, complicating matters, on November 6, 2021, the U.S. Court of Appeals suspended enforcement of the ETS provisions pending further briefing by the parties.
These new regulations will impact all employers employing 100 or more employees as of November 4, 2021. In short, employers have a choice to institute a mandatory vaccination policy requiring all employees to be fully vaccinated by January 4, 2022 or establish a policy requiring unvaccinated employees to wear a mask while in the workplace and submit to weekly COVID-19 testing. There are many new steps employers may need to implement effective December 5, 2021 and January 4, 2022, including conducting training, obtaining the vaccination status of employees, and formulating a roster of all employees and their vaccination status.
